Udyam registration replaces the Udyog Aadhaar registration for registration under MSME. In the past, Udyog Aadhaar registration was confusing and time-consuming due to multiple categories and pages. For Udyam, the MSME registration process is a one-stop, paperless process, which does not require additional documents. Thus MSME Registration Online has become more accessible and easy.

The MSME Registration Online can be applied by anyone planning to establish a micro, small, medium enterprise. Proprietors, Hindu Undivided Families (HUF), One Person Companies (OPC), Partnerships, Limited Liability Partnerships (LLP), Co-operative Societies, or any other group of individuals can easily apply for Micro, Small & Medium Enterprises.

The Act and the Ministry's notifications do not state that the Udyam Registration Certificate will be valid for specific periods, such as five years, ten years, etc. Therefore, it can be presumed that the registration is valid till the existence of Enterprise, and there is no requirement for renewal.

As per the Notification dated June 26, 2020, no enterprise shall have more than one Udyam Registration Number; for enterprises involved in manufacturing and service, both activities will be clubbed into one Udyam Registration.

Under Notification dated June 26, 2020, all Enterprises seeking registration under the Act will require a PAN and GSTIN on and after April 1, 2021.

Ministry notification dated 27.06.2017 excluded wholesale and retail trading; fisheries and aquaculture; forestry; and more. Such entities are not eligible for registration if they only engage in activities that fall under these categories.

A key part of India's economy is the micro, small, and medium enterprise sector, which plays a vital role in economic development and growth. They not only create jobs but also contribute to the development of rural and backward communities.

By MSMED Act, only partnership firms, LLPs, and companies can be entitled to the status of "MSME" and the startup status. Those businesses will be considered MSMEs if they meet the investment limits prescribed in the MSMED Act concerning the definitions of MSMEs. A proprietorship, a HUF, a public limited company, an AOP, a co-operative society may be considered an MSMEs, but not a startup.

By law, MSME is defined by the MSMED Act. In contrast, DPIIT's Start-up Notification defines a startup.

As of 30.06.2020, the new definition applies to existing enterprises as well. According to the new definition, the existing Udyog Aadhaar and EM, Part II enterprises, will be reclassified. UAM registrations are valid only until 31.03.2021. On or after 01.07.2020, all existing UAM-registered enterprises must re-register under Udyam before their UAM registration expires on 31.03.2021.

Not at all. According to the Income-tax Act, 1961, small businesses can take advantage of the following benefits regardless of filing Udyam Registration.
  1. A partnership firm, individual, or HUF with an annual turnover of not more than Rs. 2 crores can opt for presumptive taxation under section 44AD of the Income-tax Act, 1961.
  2. From the assessment year 2020-21, small businesses which come under clause (a) of section 44AB of the Income Tax Act, 1961 and whose turnover or gross receipts do not exceed Rs. 5 crores are exempt from compulsory tax audit under section 44AB if:
    1. An aggregate of all amounts received during the previous year, including sales, turnover, and gross receipts, is not more than 5 percent of the said amount; and
    2. The sum of all cash payments, including expenditures, does not exceed five percent of said payments in the previous year.
    3. A small business that doesn't meet the above conditions is exempt from audit for turnover up to Rs. 1 crore.
  3. A company whose revenue does not exceed Rs. 400 Crore in a financial year is eligible for a tax concession of 25% for small and medium-sized enterprises as per the Finance Act.
