Here Are Some Frequently Asked Questions

Trademark Registration is highly recommended but not compulsory. Many well-known marks are unregistered and recognized, and also prior use is not required for trademark registration. The registration is valid for 10 years, but it can be renewed before 6 months of validity expiry. In this way, it can be protected for life.

Words should be easy to pronounce, spell, and remember. Trademarks that are invented words or coined expressions and geometric designs that are rare will be effective.

It takes around one year or more to get the Trademark registered. But the TM symbol can be used from the day of applying.

Step 1: Application for Trademark
Step 2: Examination Report:
The Trade Marks Office examines a trademark application two to four months following the application filing. If no objections are raised, the mark shall be allowed to be advertised directly.
Step 3:Response to Examination Report:
Upon receipt of an examination report, an applicant is required to file a response within one (1) month from the date of receipt of the examination report, failing which the application is deemed abandoned. When a reply is filed and approved by the Trademarks Office, the application is published in the Trademarks Journal. If the Examiner has further objections, the Applicant would have a show cause hearing.
Step 4 :Advertisement:
Once the objection/s to the trademark application is addressed, the trademark application is advertised in the Trademarks Journal.
Step 5 :Opposition:
As soon as the Trademark is advertised, it is open for opposition for four (4) months. The mark proceeds to registration if no opposition is filed within the stipulated time.

A trademark can be transferred or assigned by paying an appropriate fee to the trademark registry.

If an Individual/Startup/MSME applies for a trademark application under three classes, the Government fee will be Rs. 13,500. For Companies etc., other than an individual, the government fee for each class is Rs.9000.

Business entities generally register trademarks in their company's name rather than in one of their founders. Regardless of the company's legal status, trademarks owned by its founder would remain valid.
