What is a Trademark renewal?

Trademarks have a validity period of up to 10 years. To continue protecting your asset legally, you must renew your trademark after that. It is vital to submit trademark renewal requests six months before the expiration of the trademark. Trademark registrars will remind you that your registration will expire soon. A letter will indicate the terms of expiration and the fees to be paid for renewing the trademark. If you do not submit a renewal or registration required by the Registrar, your trademark will be removed from the Trademark Journal.

When a trademark is renewed, its rights which registered trademarks can only enjoy, remain intact. If a trademark owner fails to renew his trademark, he forfeits all trademark protection.

In some cases, a person may forget to renew their trademark within the specified time frame. In such circumstances, there is an option available. In the event of a failure to renew a trademark, one can attempt to restore it. A trademark can be restored only within one year of its expiration. A fee for restoring a trademark is in addition to the renewal fee.

Yes, as long as you renew the mark every 10 years and pay the prescribed trademark register fee within 6 months from the expiration date.

Renewal applications are not examined in India, as filing for renewal within the statutory period is a matter of right.

Trademarks Act, 1999 (Section 25 (3)) and Trade Marks Rule, 2017 (Rule 57) prescribe that a trademark renewal application is to be filed: anytime not more than one year before the expiration of the last registration of the trademark by paying the prescribed renewal fees, failing which the trademark will be removed from the register.

The consequences of non-renewal are severe. The trademark would be removed from the register, and anyone can claim it.

Under the Trademark Act, the proprietor has yet another opportunity to renew the trademark within six months after the date of expiration of registration by filling out the prescribed form [TM-10] and by paying the surcharge.

Upon expiration of the renewal period and no application has been filed, the proprietor may request restoration of the trademark. However, you must apply within six months to one year of the date of expiration of the registration.

To ensure that the trademark is truly renewed or restored, the Registrar shall advertise it again and seek opposition from anyone who believes that the mark should not be renewed or restored. If no objections are raised within the prescribed waiting period, the mark will be entered into the trademark register. There shall be an entry that indicates the mark has been renewed for ten years.

The trademark holder shall have the option of restoring its use after six months have passed after expiration. This must be done within six months to twelve months after the expiration date. The government fee for the same is Rs.18000/-
